Online bidding only opens Monday January 20th, 2024. Online bidding only ends Friday January 24th, 2024 at 10AM.
All bids are placed on a per acre basis (your bid times the total acres).
Bidders will be required to register and sign terms/conditions before bidding on the auction.
The successful high bidder for each tract, upon completion of the Real Estate Auction, mustcomplete and sign a purchase agreement and render 15% of the purchase price (earnest money)as a deposit on Real Estate in the form of a personal check, business check, certified funds orwire payable to Closing Company.
Closing company to be First American Title in Kansas City MO. Balance due at final closing on or before February 28, 2025.
United Country Property Solutions LLC must receive a signed copy of the contract (handdelivered, faxed, or scanned and emailed) within 24-hours after the buyer has been notified thatthe sellers have accepted his or her bid.
Owners have the right to accept and/or reject any or all bids. No offer to purchase the propertyshall be binding on the Owner until such time as the Owner and Prospective Buyer have enteredinto, and both have fully executed, a binding purchase and sale agreement and said agreement is approved and confirmed by trustees legal representatives.
Once fully executed,this agreement shall be binding on the parties and their successors and assigns. Purchaser(s) may not assign the Purchase Agreement nor any of the rights or benefits thereof including, without limitation, the benefit of the representations and warranties of Seller contained herein, to any third party either before or after the Closing without the written consent of Seller which may be given or withheld in Seller’s sole discretion, and any such unauthorized attempted assignment shall be null and void.
This agreement is NOT subject to financing, inspections, or other contingencies or delays theclosing for such reason. Out of area personal checks must be with the approval of the AuctionCompany personnel. Anyone not known by the Auction Company or sellers may be required toshow proof of Bank Letter of Credit. Sale is non-contingent; failure to close will result inforfeiture of the earnest money. Buyer must secure their own necessary financing approval priorto the auction.
Sale is subject to owner confirmation and reserves the right to accept or reject anyand/or all bids. The property is sold “As Is, Where Is With All Faults” and no warranty orrepresentation, either expressed or implied concerning the property is made by the seller orAuction Company.
Neither the Seller or Auction Company guarantees condition or suitability ofproperty and requires potential bidders to inspect the property before bidding. Sellers and/or theAuction Company do not guarantee acres. Any fencing, improvements, or surveys required onbuyers behalf of the transaction will be at the buyers expense.
Taxes will be pro-rated to the day of closing. Guaranteed Marketable Property Title to prospective buyer. Seller shall provide an Owner’s Policy of Title Insurance in the amount of the purchase price and shall execute a proper deed conveying the real estate to the buyer. Farms are leased for the 2023 crop year through February 28, 2024, new owners shall gain possession after this date unless arranged otherwise between buyer and tenant. Sale shall include all mineral rights owned by the seller if any. Property is sold based on the legal description.
